Bracewell’s Tim Wilkins participated in The Construction Broadsheet’s “Legal Q and A” column to answer questions about how to avoid environmental regulatory pitfalls on construction projects.
Wilkins addressed an example of a sub-contractor coming across old barrels with hazardous material markings by saying, “Under the environmental laws, primary responsibility for waste disposal activities falls on the owner or operator of the facility where disposal has occurred, not on a contractor who merely happens to discover such disposal.”
