As investment in data center infrastructure accelerates, developers and operators are facing increased intellectual property risks stemming from the complex network of vendors, suppliers and technology providers involved in building and operating facilities. The resulting disputes are drawing greater attention to contractual protections, supply-chain relationships and ownership of proprietary technology.
Most operators don’t create the various systems of technology within the facilities, but instead rely on third-party providers, Bracewell’s Conor Civins told Bloomberg Law.
The best way data center developers and operators can protect themselves is through contracts, Civins said.
