Michael Brooks will present on “Under the Microscope: Attorney Ethics in Managing FERC and CFTC Investigations” at the International Energy Credit Association 2026 Annual Conference. When a government inquiry begins, legal and ethical obligations arise immediately and they do not always align. This panel will examine the professional responsibility issues that arise throughout FERC and CFTC investigations, from the earliest signs of potential misconduct through resolution.

Drawing on practical experience, the panelists will discuss key ethical and strategic considerations at every stage of the process, including conducting internal investigations while preserving privilege, delivering Upjohn warnings and managing the competing interests of corporations and individual employees, and communicating effectively with regulators. The discussion will also explore how counsel can balance duties of candor, confidentiality, and client advocacy in an enforcement environment where FERC and CFTC staff expect cooperation while exercising significant investigative authority.
