Texas’ decision to halt permitting for new data center projects pending an Electric Reliability Council of Texas audit is creating significant uncertainty for developers, lenders and investors. The pause, which could extend through mid-December, has raised concerns about project timelines, financing arrangements and whether some developers may redirect investments to other markets.
Bracewell’s Matt Paulson told New Project Media the permit pause creates substantial uncertainty for developers, particularly as questions remain about whether the Texas Commission on Environmental Quality is pausing permit processing altogether or simply delaying final approvals.
“There are lots of questions and there are areas of uncertainty,” Paulson said.
Bracewell’s Jared Berg told New Project Media that prolonged permitting delays could have meaningful consequences for project financing and sponsor commitments.
“Three months delay can sometimes be managed, but six months is a huge delay and is more likely to create problems,” Berg said.
Bracewell’s Bryan Clark said that some clients who had planned data centers in Texas have withdrawn projects from the state amid the halt on data center development. He added that the projects most likely to be abandoned are those that are more complex to develop, such as projects requiring additional permitting or approvals.
