The US Supreme Court unanimously ruled in Jules v. Balazs Properties that federal courts retaining jurisdiction over a dispute sent to arbitration also retain jurisdiction to enforce the resulting arbitral award. Bracewell’s J.P. Duffy told Law360 that the decision is as part of a broader trend.
“The Supreme Court’s ruling in Jules is both a natural extension of the Spizzirri decision (as well as the textual approach taken in Badgerow), and a further example of the pro-arbitration stance the court has reaffirmed numerous times over the last two decades,” said Duffy. “It also provides predictability at the enforcement stage and limits enforcement forum shopping, which is good for commercial disputes, as well as generally.”
