Bracewell lawyers Martin Gusy, J.P. Duffy, Parker Lee, Tyler Johnson and Camille Ng, along with Grant Hanessian of Hanessian ADR and Laura Hardin of BRG, will speak on a panel titled “Fueling Disputes: Energy Arbitration and the Tribunal’s Evolving Role in Shaping Expert Evidence” at New York Arbitration Week on Friday, November 20 at 10:30 AM – 12:00 PM ET.

Energy disputes sit at the intersection of technical complexity and geopolitical urgency and routinely turn on expert issues about which Tribunals must be educated, such as technical, engineering, pricing, and valuation questions. This panel examines how arbitration practitioners with deep energy-sector expertise can help bridge that gap, and turns a critical eye to CIArb’s 2026 Report on Party-Appointed Expert Witnesses, which found that tribunals and experts sharply disagree on how proactive tribunals actually are in shaping expert evidence pre-hearing. Should arbitrators move beyond procedural housekeeping and take an active hand in framing the scope, format, and sequencing of expert testimony before reports are finalized, particularly where late-stage surprises are costly. Can efficiency and clarity gains of early tribunal engagement outweigh due process, party autonomy, and perceptions of pre-judgment?
