Bracewell’s Jeff Holmstead told Inside EPA that he anticipates that “within the first couple of weeks” of Donald Trump’s second term that the administration will ask courts to pause cases challenging major Biden-era Environmental Protection Agency (EPA) climate rules, including its power plant emissions rule.

Holmstead believes that the courts would almost certainly grant such requests.

Trump’s incoming team is “aware of that” history, Holmstead said, noting Trump’s first term where the administration quickly issued pronouncements stating it was pausing various Obama-era climate rules only to have the courts strike down many of those informal orders.

Holmstead added that Trump now has a more thought-out and prepared transition team. “They’re coming in with an actual plan to operate.”
