The Trump administration is escalating its attacks on “polluter pays” lawsuits that try to force fossil fuel companies to help cover the costs of climate change. Bracewell’s Brittany Pemberton told The New York Times that the outcomes so far in courts were “already a bit of a patchwork quilt,” particularly on the complex issue of whether federal or state courts are the right place for cases like these. Pemberton said she expects the Supreme Court to intervene once the cases are further along.
