ECN’s first of three Summer Sessions was titled “The Attorney-Client Privilege and Work-Product Doctrine.” It took place virtually on August 19, 2020. This session focused primarily on the attorney-client communication privilege and work-product doctrine with the goal of helping participants understand the scope and fragile nature of the doctrines. We discussed how to establish and preserve the protections and looked at real-life examples in the context of CFTC and FERC enforcement matters. This was the first in the series and set the stage for the next two sessions. It was intended for lawyers and non-lawyers alike.
