Litigation has become an increasingly prominent tool for environmentalists in recent years, a trend Bracewell’s John Gilbert told E-FWD is not going away any time soon.

“Each year we’ve seen new, and in some cases novel, attempts to find ways to use litigation to apply pressure on governments and on companies,” said Gilbert. “I have no doubt that that will continue.”

Gilbert predicted that there would be a particular focus on finance and how its supplied to the energy industry, while also continued scrutiny over allegations of greenwashing. He also indicated that there will be new legal cases, where hydrocarbon opponents will find new vectors by which to pressure companies’ plans, such as oil and gas companies needing to come up with new ways to account for and address scope 3 emissions.
