On September 17, 2020, the Federal Energy Regulatory Commission (FERC) issued a landmark final rule pertaining to the participation of DER in wholesale markets. Participation of Distributed Energy Resource Aggregations in Markets Operated by Regional Transmission Organizations and Independent System Operators, Order No. 2222, 172 FERC ¶ 61,247 (2020). On October 28, three Bracewell power regulatory lawyers provided a high level overview of Order No. 2222 and discussed the order’s implications for DER owners and developers, DER aggregators and others in the industry.
