Seth Barsky will speak at the Special Institute on the National Environmental Policy Act conference. Seth will participate in a panel discussion titled “A Practitioners’ Guide to the Administrative Record – Scope, Privileged Documents, Supplementation.” This panel will examine the legal framework for preparing administrative records, their role in judicial review of NEPA compliance, and agency practices for compiling and certifying records. Discussion will cover documents typically included or excluded, supplementation of the record, and the use of FOIA by project opponents to access government materials outside the record.
