Bracewell Scores Class Action Victory for Flight Centre Travel Group

NEW YORK – Bracewell LLP represented Flight Centre Travel Group in an action brought by a private plaintiff under Title III of the Americans With Disabilities Act (ADA), alleging that Flight Centre’s website is a public accommodation that is not equally accessible to individuals with certain visual impairments or disabilities.  

Flight Centre filed a motion to dismiss in May 2020, arguing that in the Third Circuit, where the case was pending, a website standing alone is not a place of “public accommodation” within the meaning of the term under the ADA. The plaintiff amended his complaint, and a second motion to dismiss was filed on June 26, 2020. The case was dismissed with prejudice on July 29, 2020.

Flight Centre is one of the world’s largest retail travel groups with more than 30 brands that includes the iconic US travel agency, Liberty Travel.
