About Phil

Phil Ricketts represents energy and telecommunications clients in rate cases, mergers, acquisitions and power sales. Having previously served in multiple positions at the Public Utility Commission of Texas (PUCT), Phil now assists clients on their regulatory matters, with particular focus on contested cases and rulemaking proceedings at the PUCT. Phil also has experience in judicial appeals of these proceedings’ determinations, and has participated in regulatory proceedings in several other states.

Phil's clients include electric utilities, nuclear, wind and other independent power producers, cogenerators, fuel suppliers and transporters, telecommunications providers and broadband over power line providers. At the agency level, Phil has represented clients in rate cases, merger and acquisition approvals, licensing proceedings, local franchising, tariff and contractual disputes, claims of anti-competitive conduct, and industry restructuring proceedings. In addition, he has served as an expert witness in state and federal court litigation, and has participated in numerous business transactions involving utility issues.

He is a former commissioner, chairman and chief administrative law judge of the PUCT. He also served as chief of the utility section of the Texas Attorney General's Office, and lead counsel in the first electric utility rate proceeding at the PUCT following industry restructuring in 2001.

Recent Notable Matters

AEP Texas Central Company and AEP Texas North Company — three transmission and distribution rate cases filed with the Public Utility Commission of Texas. Currently represents AEP Texas Central Company in the judicial appeal of its 2008 rate case.

Public Service Company of Oklahoma — electric utility rate case before the Oklahoma Corporation Commission

A Canadian pension fund and the sovereign wealth fund of the Government of Singapore — acquisition of 20% of the common stock of Oncor Energy

Current Communications — litigation and regulatory dispute with AT&T over pole attachment issues

PNM Resources — Texas regulatory counsel in the acquisition of TNP Enterprises. Also led the Texas due diligence effort in that transaction.

Central and South West Corporation — Texas regulatory counsel for in the merger with American Electric Power Company Inc. Assisted in the filing and litigation of requests for approval of the merger in agency proceedings in Louisiana, Arkansas, Oklahoma and at the Federal Energy Regulatory Commission.
