Bracewell & Giuliani LLP’s appellate group secured a victory in the First Court of Appeals for the First District of Texas, on behalf of the Texas Windstorm Insurance Association (TWIA), a Texas coastal windstorm insurer. The First Court of Appeals issued its opinion reversing the trial judge’s disqualification order and vindicating TWIA’s position.
In the wake of Hurricane Ike, there have been more than 10,000 cases filed against TWIA. In February 2013, a district court disqualified TWIA’s managing counsel from representing TWIA in all of the approximately 1,000 cases pending in Galveston County. TWIA sought mandamus relief from the Court of Appeals. Bracewell was hired to represent TWIA in the appeal.
