Tax Energy Outlook for 2020

Lawmakers will confront a pressing array of energy tax issues and increasingly impassioned groups of constituents. Many of the nation’s renewable energy tax incentives, extended at the end of 2019, will expire at the end of December. Additionally, the international chaos created by the coronavirus has led to many unanticipated interruptions in supply and construction of energy facilities, leading taxpayers clamor to Congress for relief in the form of extended placed in service deadlines and relaxed enforcement of continuing construction rules. Lawmakers representing the oil patch states may similarly advocate for tax changes to buffer the impact of a nationwide recession and steep demand drop for conventional energy products. Bracewell experts identified who are likely to be the most influential voices in upcoming negotiations, walked through the list of energy sector tax legislative requests, described some of the possible legislative “vehicles” that could carry a package, and explored what a 2020 energy tax title could carry.

Federal Rulemaking Update: Water, Air, and NEPA

Bracewell hosted a Federal Rulemaking Update session where we briefly discussed a number of major initiatives that will have significant implications for the regulated community. We reviewed regulatory actions that affect the jurisdictional scope of the Clean Water Act, revise key procedures under the National Enviromental Policy Act, clarify the implementation of Section 401 of the Clean Water Act, reform various Clean Air Act programs, and codify the exclusion of incidental take from the reach of the Migratory Bird Treaty Act, among others. Given that all these actions are certain to be challenged in court, we also briefly reviewed what these legal challenges are likely to be.
